Do I have to be in a faction?

Yes.

Why was I put into faction X?

It was random -- based on the relative cash held by each faction. Ie, the faction with the most cash has the greatest chance of getting new players assigned.

Who are the members of the faction council?

The top three players of in the faction make up the council.  Members are determined at the end of each game year.

What do the faction council members do?

They decide on the cost/rates of loans, training, food, stables, commissions on transactions, dues, reports, and what they get paid to be a council member. These values can be seen on the Halls of Fame page.

I have to make an annual contribution to my faction and I also have to pay my faction for food, training, and stable. The faction also gets a commission on all sales. What is the purpose of the factions and where does this money go? Is it just so that the fat cats at the top get fatter?

Factions provide roughly half the racing purses. The factions own the stables and supply food and trainers. They add a % to the basic costs. The council of each faction sets the rates to balance new members vs charges -- eg, keeping interest low for new players vs stable rates for large horse owners. A high food and training rate hits the biggest owner the most (some are paying $1 million per year).

As far as catching the fat cat faction councilmen, the top 12 positions change frequently. The green and yellow factions in particular are up for grabs.

My turn update says I could switch to the green faction and be a council member #3 or #2, I'm currently the #3 player in the Red Faction, so does that mean I will be part of red council at the end of the year if I keep there or higher?

Depends on your prestige -- check the main hof page to see where you stand relative to other players.   Deciding on red or green would also mean looking to see how much money each has and what % the factions are paying out to the top 3 players.
